XG cannot accept liability of any statements made which are clearly the sender’s own and not expressly made on behalf of XGenie or one of its business partners (include affiliates, partner recruitment firms and associated companies, service providers, and sub-contractors engaged in provision of recruitment and human resources services).
Personal Data and Privacy Policy
Personal data consists of any information XG collects in identifying you, or from which you are reasonably identifiable. We understand the importance of addressing data privacy and use best efforts to protect the personal information given from candidates and clients, so that the information provided to XG is utilised in the way you consented. We also ensure that it aligns with the Personal Data (Privacy) Ordinance (the “PDPO”) of Hong Kong. As our policy extends to different markets, you will find that is more than legislative requirements in each location.
Purpose of Personal Data Collection
Data collects through XG, our business partners, and job posting channels (direct and indirect) which are for sole use of XG, our business partners, and/or clients. XG shall maintain a record of candidate’s name, contact address and number, and Hong Kong Identity Card number (ID). In case of non-Hong Kong resident, passport number and citizenship will be collected. These are used to comply with the Hong Kong Employment Ordinance.
We intend to use your personal data to compile with market statistics and enable direct marketing activities related to job searching and human resources development. XG and business partners might provide job market information through direct marketing activities, consisting, but not limited to, XG’s services, events, press releases, surveys, and technology updates. While we do intend to utilize your personal data for direct marketing and non-direct marketing purposes for future communication.
The data collection is happening at different scenarios of recruitment processes, but not necessarily limited to, as below:
Business Partners and Clients:
- Establish and maintain business relationship in sustaining and exploring business opportunities;
- For internal operations purposes, e.g. finance and accounting, legal, management functions;
- To manage any legal actions, compliance to governmental regulatory purposes.
Candidates:
- On-line or email enquiries and application submissions;
- Teleconversation during application screening or interviews;
- Application forms (include photographs, if provided) and submitted documents’ content during interview processes;
- Face-to-face interviews (include video conferencing and recording);
- CCTV/security recordings, GPS/location tracking information;
- References, verifications, and information gathered from candidates’ previous and/or existing employers on behalf of business clients;

Disclosure of Information and Data
XG is the owner of the personal data and information collected during business operation, candidate registration, and recruitment processes (includes, but not limited to, screening and interview processes). All information is provided on a voluntary basis. By providing any of your personal data to XG, you hereby agree that XG shall collect, retain, and use the data in any format, including (without limitation) data files, text, computer software, images, graphics, video clips, audio files, databases for the following purposes:
- Use within XG’s internal recruitment processes. Personal data may include name, ID number, contact number and address, email address, and professional related information, such as, but not limited to, dates of employment, years of experience, specialized knowhow, etc.., which may be forwarded, transmitted to XG’s recruiters, including business partners and clients, providing human resources services for companies with staffing and development needs; if applicable, your terms of employment;
- Provide information of business partners and clients, including companies looking for new staff, but not limited to, to job seeking candidates in recruitment processes;
- Discussions with existing and potential business opportunities in relation to recruitment and human resources development needs;
- Discussions with professional advisors (including lawyers and auditors);
- Any third party, including but not limited to, business partners and clients, contractors or service providers, such as website administration, IT technology, telecommunications, banking, insurance, marketing, advertising, delivery, research utility, and security services request to use, disclose, retain, or transfer such personal data in relation to XG’s business operations;
- We may dispatch promotional information via direct marketing telephone calls, emails, e-messages, direct mailings, etc.., to you for performing statistical analysis;
- To verify information given by candidates, business partners, and clients. For candidates’ information verification may include, but not limited to, checking of academic qualifications from issuing authorities, confirmation of existing and previous employment records including salary details and designated referees, or credit reference agencies;
- Where requires by applicable laws, XG reserves the right to disclose identifiable information to respond to any claims or legal process, where we consider that such use or disclosure is necessary to, or where XG suspects that fraud or unlawful activity has been, is being or may be engaged in XG’s business and to protect ourselves and/or users;
- When a third party requires to perform functions or obligations as required under the laws, regulations, orders, and/or guidelines (no matter under force of law or not) or required by any governmental and/or non-governmental authorities.
Information and data collected by XG may disclose to third parties and retain in our files or databases per details outlined in this agreement. XG is not responsible for the retention, use, or privacy practices of business partners and clients.
Retention and Storage of Personal Data
Successful registered candidates with XG have the right to edit or remove their personal data from XG’s database. The personal data shall be stored either in hard copies in XG’s offices or saved in servers which operate by XG’s service providers in/outside your country.
XG will keep these data for the purposes of human resources development purposes, includes recruitment, or necessary regulatory investigation, detection and prosecution of crime. XG may destroy any personal data in accordance to internal policy to protect XG’s interests.
Rights under Privacy Policy
Under the Privacy Policy and the terms of the Hong Kong Personal Data (Privacy) Ordinance, and subject to the exemptions specified in the Ordinance or Act, any candidate has the right to:
- check whether XG keeping his/her personal data and get copies of such related data on payment of a prescribed fee;
- request XG correcting his/her personal data if found inaccurate, incomplete, and/or misleading;
- ensure XG complying to laws and regulations in relation to privacy policies.
Acceptance of Privacy Policies
With your use of this website; and/or candidates submitted CV through any of XG’s job search channels; and/or completed interview processes with us; and/or when business partners and clients engage in business discussions, service provisions, or partnership, these signify your acceptance of XG’s Privacy Policy and your agreement to be bound by them. XG reserves the right to amend Privacy Policy from time to time without prior notice. You are advised to check in a regular basis for any updates.
Please be aware that in the event of insufficient personal data provided or is not satisfactory to XG and/or business partners and clients’ requests, your application for any of the above purposes as set out may not be accepted or provided full range of services XG offers.
